MEDIATION AND FAMILY DISPUTE RESOLUTION

When relationships break down and separation is contemplated or has occurred the role of a Mediator is to assist clients to have respectful, future focused, and child focused conversations, with the aim of working towards agreements regarding parenting and/or property and financial matters.

Mediation is a voluntary and confidential process which is child focused and future focused.

Family Dispute Resolution (FDR) is a structured process where the Mediator’s role is to facilitate discussions, assist clients to communicate with and listen to each other, and to consider all options for settling any disagreements. It is not the role of the Mediator to give legal and/or financial advice. Clients are strongly encouraged to obtain legal and financial advice relevant to their personal situation.

 

The FDR process begins with an Intake session with each client which usually takes 1.5 to 2 hours. A fixed fee of $400 is charged for each client for the Intake Session (no GST is charged). If mediation (FDR) is suitable and both clients agree to proceed then a joint mediation session is scheduled and the hourly rate is $200 per person per hour of mediation (no GST is charged).

 

If mediation is deemed not suitable then Rhoda will issue Certificates regarding Parenting matters, or a letter of attendance regarding Property and Financial matters.

COLLABORATIVE PRACTICE.

Sometimes a team approach works better for separating clients and Rhoda can facilitate a Collaborative Process where each client engages a Family Lawyer, and when there are complex property issues, a Financial Neutral can also be engaged to assist the separating couple.
